Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the bakeagainstthegrain.comwebsite (the “Site”) and your purchase of products from The GF Oven LLC, doing business as Bake Against The Grain (“The GF Oven LLC”, “we”, “us”, or “our”), a gluten-free bakery based in Elmira, NY. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Products and availability
We offer small-batch, limited weekly drops as well as seasonal and custom orders. Each batch is a fixed quantity, and items may sell out. We do our best to display products, descriptions, and pricing accurately, but we do not warrant that all content is error-free, and we may correct errors, change products, or update pricing at any time without notice.
Allergen and food-safety notice
Bake Against The Grainis a 100% gluten-free kitchen—no wheat-based products are made or stored in our kitchen, and we do not use shared equipment with gluten. However, other allergens (including dairy, eggs, nuts, and soy) may be present. Please review individual product pages for allergen information and contact us before ordering if you have specific dietary needs. You are responsible for determining whether a product is safe for you. Our products are intended for personal consumption and should be stored and handled appropriately.
Orders, pricing, and payment
- All prices are listed in U.S. dollars and are subject to applicable taxes and any shipping fees calculated at checkout.
- Placing an order constitutes an offer to purchase. We reserve the right to accept, limit, or decline any order.
- Payment is processed through our checkout and payment providers at the time of purchase. You represent that you are authorized to use the payment method you provide.
Fulfillment: pickup and shipping
We offer farmstand pickup in Elmira, NY and shipping within New York State only. We do not currently offer local delivery or shipping outside New York. For pickup orders, you select a pickup date and time window at checkout and are responsible for collecting your order during that window. For shipped orders, title and risk of loss pass to you upon our delivery to the carrier. Because our products are perishable, we are not responsible for delays caused by the carrier or for items left uncollected.
Custom orders
Custom orders require at least 72 hours’ notice, and larger or more intricate orders may require additional lead time. Submitting a custom-order inquiry does not guarantee availability; a custom order is confirmed only once we accept it and any required payment or deposit is made. Custom orders are made to your specifications and are generally non-refundable once production has begun. See our Custom Orders page for details.
Cancellations, refunds, and returns
Because our products are freshly made and perishable, all sales are generally final and we are unable to accept returns. If something is wrong with your order, please contact us promptly at kaci@bakeagainstthegrain.com and we will work with you in good faith to make it right. Cancellation and modification requests are handled on a case-by-case basis and may not be possible once an order is in production.
Acceptable use
You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or use it in any way that could harm us or other users.
Intellectual property
All content on the Site—including text, photographs, graphics, logos, and the Bake Against The Grain name—is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, reproduce, or use our content without our prior written permission.
Disclaimers and limitation of liability
The Site and our products are provided “as is” to the fullest extent permitted by law. To the maximum extent permitted by applicable law, The GF Oven LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Nothing in these Terms limits liability that cannot be limited under applicable law. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New York.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
